Why would it not be covered by warranty?

Thankfully in Europe we have two stage warranty. The one offered by the producer and the basic one enforced by the regulations. The latter covers all issues that are clearly production or quality issue and not due to regular wear and tear. This basic protection can't be overruled

Fake and gay. Warranty (in europe at least) will 100% cover any such defects for a minimum of 2 years
Apple replaced all those units, saying warranty does not cover it is just a lie. Still a major design flaw.
